At Backflexexpel, we want you to be satisfied with your purchase. This Return Policy outlines your rights and the procedures for returning products purchased from our website.

This policy complies with Austrian consumer protection laws, including the Consumer Protection Act (Konsumentenschutzgesetz — KSchG), the Act on Distance and Off-Premises Contracts (Fern- und Auswärtsgeschäfte-Gesetz — FAGG), and EU consumer rights regulations (in particular Directive 2011/83/EU as implemented in Austria).

2. Right of Withdrawal (Consumer Right)

As a consumer within the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason.

2.1 Withdrawal Period

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you (other than the carrier), physically acquires the goods.

2.2 How to Exercise Your Right

To exercise your right of withdrawal, you must inform us of your decision by a clear statement. You can:

3. Conditions for Returns

3.1 Eligible Products

Products eligible for return must be:

  • Returned within 14 days of receiving the goods
  • Unopened and in original sealed packaging
  • In the same condition as received
  • Accompanied by proof of purchase

3.2 Non-Returnable Items

For health and hygiene reasons, we cannot accept returns of:

  • Products that have been opened or unsealed
  • Products where the seal has been broken
  • Products that show signs of use or tampering

This exception is in accordance with Article 16(e) of EU Directive 2011/83/EU regarding sealed goods not suitable for return due to health protection or hygiene reasons.

4. Return Process

  1. Contact Us: Notify us of your intention to return within 14 days of receiving the product
  2. Receive Instructions: We will provide you with return shipping instructions and a return authorization
  3. Package the Product: Securely package the unopened product in its original packaging
  4. Ship the Return: Send the package to the address provided within 14 days of notifying us
  5. Confirmation: Once received and inspected, we will confirm the return

5. Return Shipping Costs

You are responsible for the direct cost of returning the goods unless:

  • The product was defective or damaged upon arrival
  • We sent the wrong product
  • The product does not match its description

In these cases, we will cover the return shipping costs.

6. Refunds

6.1 Refund Timeline

We will process your refund within 14 days of receiving the returned product, or 14 days after you provide proof of shipment, whichever is earlier.

6.2 Refund Method

Refunds will be issued using the same payment method used for the original purchase. If this is not possible, we will contact you to arrange an alternative.

6.3 Refund Amount

You will receive a full refund of:

  • The product price
  • Original standard shipping costs (if applicable)

If you chose a delivery method more expensive than standard shipping, we will only refund the standard shipping cost.

Unless you agreed otherwise, we will reimburse you using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

If you exercise the withdrawal right, you are only liable for any diminished value of the goods where that loss in value is due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7. Defective or Damaged Products

If you receive a defective or damaged product:

  • Contact us immediately upon discovery
  • Provide photos of the damage if possible
  • We will arrange for a replacement or full refund at no additional cost to you

Under Austrian law, you have a legal guarantee of 2 years for defective products (Gewährleistung).

8. Exchanges

If you wish to exchange a product for a different item, please follow the return process and place a new order. This ensures the fastest processing of your request.

9. Special Circumstances

9.1 Gifts

If the product was purchased as a gift, the refund will be issued to the original purchaser unless otherwise arranged.

9.2 Promotional Items

Products purchased during promotions or with discount codes follow the same return policy. Refunds will reflect the actual amount paid.

10. Your Legal Rights

This Return Policy does not affect your statutory rights under Austrian and EU consumer protection laws. You always retain your legal rights to:

  • 14-day withdrawal right for distance purchases
  • 2-year legal guarantee for product defects (Gewährleistung)
  • Protection against unfair contract terms
